HVAC INSTALLATION, WARRANTY & SERVICE AGREEMENT
Cool Season Comfort Time (CS Comfort Time) / Braza Builders
This HVAC Installation, Warranty, and Service Agreement applies to qualifying HVAC installation, replacement, electrical, warranty, diagnostic, repair, and maintenance services performed by Cool Season Comfort Time, also referred to as CS Comfort Time, and/or Braza Builders.
Throughout this Agreement, CS Comfort Time and Braza Builders may collectively be referred to as the “Company.”
By approving an estimate, signing a proposal, paying a deposit, authorizing the purchase of equipment, or allowing work to begin, the customer acknowledges and agrees to the following terms and conditions.

1. Equipment Warranty
Equipment warranties are provided by the equipment manufacturer and not directly by CS Comfort Time or Braza Builders.
Manufacturer warranties commonly range from five to ten years, depending on:
- Equipment brand and model
- Type of component
- Registration requirements
- Installation date
- Manufacturer warranty conditions
- Maintenance requirements
- Property type and equipment application
The exact warranty period is determined by the manufacturer’s written warranty policy for the equipment selected.
When applicable, CS Comfort Time or Braza Builders may assist with registering eligible equipment with the manufacturer. Registration assistance does not make CS Comfort Time or Braza Builders the provider or guarantor of the manufacturer’s warranty.
The customer is responsible for providing accurate ownership, property, contact, and installation information needed to complete the registration.
The customer should retain copies of the estimate, invoice, model and serial numbers, equipment registration, and manufacturer warranty documents. Manufacturer coverage, exclusions, claim procedures, parts replacement, and equipment replacement decisions remain subject to the manufacturer’s warranty terms.

2. One-Year Labor Warranty
CS Comfort Time and Braza Builders provide a one-year labor warranty covering installation-related workmanship performed directly by the Company.
The labor warranty begins on the date the installation is substantially completed.
If, during the one-year labor warranty period, an issue is inspected and determined to have been caused directly by improper workmanship performed by CS Comfort Time or Braza Builders, the Company will correct the covered installation issue without charging the customer for the covered diagnostic visit, labor, or corrective installation work.
The labor warranty applies only to the specific work performed by the Company and does not convert the manufacturer’s equipment warranty into a labor warranty.
Coverage is limited to the original customer, original installation location, and original equipment installed under the applicable estimate or invoice unless otherwise agreed in writing.

3. Electrical Installation Warranty
Electrical workmanship is covered under the one-year labor warranty only when the electrical work was specifically performed by CS Comfort Time or Braza Builders and listed in the customer’s estimate, invoice, or scope of work.
When the Company installs a dedicated electrical circuit, coverage is limited to the specific electrical work performed by the Company, which may include:
- Dedicated electrical wiring installed by the Company
- Breaker installed by the Company
- Disconnect installed by the Company
- Conduit and fittings installed by the Company
- Electrical connections made directly by the Company
- Electrical workmanship associated with the installed HVAC equipment
The Company is not responsible for electrical systems, circuits, breakers, panels, wiring, equipment, or connections that were not installed or modified by the Company.
The electrical labor warranty does not cover damage or failures caused by:
- Lightning strikes
- Power surges
- Utility-company voltage problems
- Power outages
- Low or high incoming voltage
- Defective existing electrical panels
- Existing wiring defects
- Loose or damaged connections outside the Company’s work
- Overloaded circuits
- Existing code violations
- Grounding problems outside the installed circuit
- Damage caused by another contractor
- Damage to unrelated circuits or electrical equipment
- Storms, fire, flooding, accidents, or other external events
A failure occurring after the installation does not automatically establish that the Company caused the failure. The cause must be identified through inspection and diagnosis.

4. Diagnostic and Service-Call Policy
The standard diagnostic or service-call fee is $198 per visit.
When the customer requests warranty service, a technician may inspect and diagnose the system to determine whether the reported condition is related to covered installation workmanship.
Covered warranty condition
If the inspection confirms that the problem was caused directly by covered workmanship performed by CS Comfort Time or Braza Builders during the active one-year labor warranty period:
- The $198 diagnostic fee will be waived.
- Covered corrective labor will be provided at no additional charge.
- Covered installation materials needed to correct the Company’s workmanship will be provided at no additional charge.
Non-warranty condition
If the inspection determines that the problem is not related to covered workmanship, the customer will be responsible for:
- The $198 diagnostic or service-call fee
- Additional labor, when required
- Materials and supplies
- Replacement parts
- Refrigerant, when required
- Additional travel or specialty services, when applicable
No additional non-warranty repair will be performed without the customer’s authorization.
Examples of conditions that may result in the diagnostic fee being charged include:
- Breaker switched off or tripped for a reason unrelated to the installation
- Incorrect thermostat settings
- Incorrect remote-control settings
- Dead or weak thermostat batteries
- Dead or weak remote-control batteries
- Dirty or blocked air filters
- Blocked indoor or outdoor airflow
- Power outage
- Utility-company issue
- Customer operating error
- Equipment operating normally
- No defect found during inspection
- Extreme outdoor temperatures affecting system performance
- Doors or windows left open
- Insufficient building insulation
- Excessive indoor heat load
- Manufacturer component failure
- Drain blockage caused by lack of maintenance or external debris
- Damage caused by insects, rodents, pets, occupants, or another contractor
- Any condition unrelated to the Company’s workmanship
If additional repair work is necessary, the customer will be informed of the anticipated charges before the non-warranty work is performed.

5. Customer Checks Before Requesting Warranty Service
Before requesting a warranty visit, the customer should perform the following basic checks:
- Confirm that the main electrical breaker is on.
- Confirm that the equipment disconnect is on.
- Confirm that the thermostat or remote control is on.
- Verify that the correct heating or cooling mode is selected.
- Verify that the desired temperature is set correctly.
- Replace thermostat or remote-control batteries when necessary.
- Confirm that the air filters are clean.
- Confirm that the indoor and outdoor units are not obstructed.
- Close exterior doors and windows.
- Allow the system sufficient operating time to reach the selected temperature.
- Check whether the property has electrical power.
- Consider whether extreme outdoor temperatures may temporarily limit system performance.
An HVAC system may operate continuously during extremely hot or cold weather without necessarily having a mechanical or installation defect.
A service visit during which no covered installation defect is found will be subject to the standard $198 diagnostic fee, plus the cost of any authorized service performed.

6. Manufacturer Defects and Warranty Claims
Manufacturer equipment defects are separate from the Company’s labor warranty.
When a suspected manufacturer defect is reported, CS Comfort Time or Braza Builders may, when requested:
- Inspect the equipment
- Diagnose the reported condition
- Record model and serial numbers
- Document the failure
- Prepare photographs or service information
- Contact the supplier or manufacturer
- Assist with submitting an eligible warranty claim
- Wait for the manufacturer’s review and decision
- Coordinate an approved replacement part when available
The manufacturer determines whether a claim is approved and whether it will provide:
- A replacement component
- A replacement control board
- A replacement compressor
- Another covered part
- Replacement equipment
- Credit or another remedy permitted under its warranty
CS Comfort Time and Braza Builders do not control the manufacturer’s review time, inventory, shipping time, approval decision, replacement selection, or claim requirements.
Unless specifically stated otherwise in writing, a manufacturer parts warranty does not automatically include:
- Diagnostic labor
- Removal labor
- Installation labor
- Refrigerant
- Shipping
- Freight
- Crane service
- Rental equipment
- Temporary cooling or heating
- Materials needed to install the replacement part
During the active one-year Company labor warranty, labor for a manufacturer-covered component may be included only when expressly stated in the customer’s estimate or warranty terms. After the labor warranty expires, diagnostic and replacement labor charges may apply even when the manufacturer supplies the covered part.

7. Preventive Maintenance Requirements
The customer is responsible for maintaining the HVAC equipment in accordance with the manufacturer’s instructions.
Professional preventive maintenance is recommended approximately every six months, or according to the schedule stated by the equipment manufacturer, system conditions, and property use.
Lack of maintenance can reduce efficiency, restrict airflow, cause water problems, damage components, shorten equipment life, and affect whether a particular failure qualifies for coverage under the manufacturer’s written warranty.
Any manufacturer warranty decision remains subject to the actual written warranty terms. A customer should review the specific manufacturer warranty rather than assume that every repair, part, or maintenance-related condition is covered.
Maintenance service is not included with the installation unless it is specifically listed in the estimate, invoice, maintenance plan, or other written agreement.

8. Mini-Split Customer Maintenance Responsibilities
For ductless mini-split systems, the customer is responsible for:
- Inspecting indoor-unit filters regularly
- Cleaning washable filters approximately every two to three months, or more frequently when needed
- Keeping the indoor unit unobstructed
- Keeping the outdoor unit clear of leaves, vegetation, dirt, and debris
- Avoiding the use of chemicals that may damage the coil or plastic components
- Watching for unusual water, ice, sounds, odors, or operating conditions
- Scheduling professional cleaning and maintenance when necessary
Homes with pets, construction dust, smoke, high humidity, heavy system use, or excessive airborne debris may require more frequent filter cleaning and professional maintenance.
Damage or failure resulting from severely dirty filters, blocked airflow, neglected coils, obstructed drains, or lack of maintenance is not considered an installation-workmanship defect.

9. Central HVAC Customer Maintenance Responsibilities
For central heating and air-conditioning systems, the customer is responsible for:
- Inspecting and replacing return-air filters regularly
- Using the proper filter size and type
- Keeping return and supply vents unobstructed
- Keeping the outdoor unit clear of debris and vegetation
- Maintaining appropriate drainage around the equipment
- Scheduling professional preventive maintenance
- Reporting abnormal noise, water, odors, ice, or system behavior promptly
A dirty, missing, incorrectly installed, or overly restrictive filter can affect airflow and system performance. Damage resulting from improper filter maintenance is not considered an installation-workmanship defect.

10. Installation Procedures and Standards
CS Comfort Time and Braza Builders intend to provide a clean and professional installation using accepted HVAC practices and the applicable equipment manufacturer’s instructions.
Depending on the project, installation procedures may include:
- Verification of equipment and application
- Installation of indoor and outdoor equipment
- Refrigerant line-set installation
- Communication and control wiring
- Condensate-drain installation
- Line-set insulation
- Nitrogen pressure testing
- Leak testing
- Vacuum-pump evacuation
- Refrigerant verification
- Electrical testing
- Voltage verification
- Drain testing
- System startup
- Heating-mode testing
- Cooling-mode testing
- Temperature testing
- Operational verification
- Final inspection of the completed work
The exact procedures and materials included are determined by the approved estimate, invoice, equipment instructions, site conditions, and scope of work.
EPA Section 608 certification concerns the handling, servicing, recovery, and related work involving regulated refrigerants. The Company’s EPA-certified personnel will perform refrigerant-related work within the scope of their certification. EPA certification does not replace state or local contractor licensing, electrical licensing, building permits, or municipal requirements that may independently apply.

11. Existing and Hidden Conditions
CS Comfort Time and Braza Builders are not responsible for pre-existing or concealed conditions that were not reasonably visible before work began.
Examples include:
- Existing electrical defects
- Damaged or undersized existing wiring
- Defective breakers or panels
- Existing refrigerant leaks
- Damaged or contaminated existing line sets
- Defective ductwork
- Restricted ductwork
- Hidden plumbing
- Mold
- Water damage
- Rotten wood
- Structural damage
- Hidden framing
- Underground utilities
- Concealed code violations
- Asbestos or other hazardous materials
- Defects created by previous installers or contractors
When an unexpected or concealed condition is discovered, the Company may stop the affected portion of the work until the condition can be evaluated.
Any additional work, labor, materials, specialty contractor services, or change in installation method may require a written change order or additional customer approval.

12. Permits, Inspections and Government Requirements
The installation price does not include permit applications, permit fees, plan-review fees, engineering, drawings, inspections, administrative fees, HOA approvals, or other government or association requirements unless they are specifically listed in the approved estimate or proposal.
Many projects may not require these additional services, depending on the location, project type, and applicable requirements.
However, if a permit, inspection, engineering document, licensed trade service, or other approval is determined to be required for the customer’s project:
- The requirement will be discussed with the customer.
- Additional charges may apply.
- The customer remains responsible for permit-related costs unless the Company agrees otherwise in writing.
- Work may need to be delayed or rescheduled until the applicable requirement is satisfied.
Nothing in this Agreement authorizes either party to ignore a legally required permit, inspection, license, or approval.

13. Work Performed by Other Contractors
The Company is not responsible for work performed by:
- Electricians not hired or supervised by the Company
- Plumbers
- Roofers
- General contractors
- Handymen
- Property-maintenance personnel
- Homeowners or occupants
- Previous HVAC contractors
- Internet or utility technicians
- Any other third party
Any modification, relocation, repair, disconnection, or alteration of the installed system by another person may affect the Company’s labor-warranty coverage when that work causes or contributes to the reported problem.

14. Property and Environmental Conditions
HVAC performance depends on more than the equipment alone. Performance may be affected by:
- Outdoor temperature
- Humidity
- Insulation
- Windows and doors
- Ceiling height
- Sun exposure
- Air leakage
- Number of occupants
- Appliances and electronics
- Garage doors
- Building construction
- Room usage
- Existing duct design
- Available electrical service
- Equipment cleanliness
A system’s inability to reach an unusually low or high thermostat setting during extreme weather does not, by itself, prove that the equipment or installation is defective.

15. Damage and Warranty Exclusions
Unless caused directly by covered workmanship performed by CS Comfort Time or Braza Builders, the labor warranty does not cover:
- Normal wear and tear
- Cosmetic damage
- Manufacturer defects
- Lack of maintenance
- Dirty filters or coils
- Drain blockage caused by debris or neglect
- Mold or biological growth
- Corrosion
- Flooding
- Fire
- Lightning
- Storms
- Wind
- Hail
- Falling objects
- Power surges
- Utility problems
- Freezing conditions
- Rodents
- Insects
- Pets
- Vandalism
- Theft
- Accidents
- Misuse
- Customer modifications
- Unauthorized repairs
- Third-party work
- Structural movement
- Pre-existing conditions
- Acts or events outside the Company’s reasonable control

16. Access to the Property
The customer agrees to provide safe and reasonable access to:
- The HVAC equipment
- Electrical panels
- Thermostats
- Attics
- Crawlspaces
- Mechanical rooms
- Garages
- Indoor installation areas
- Outdoor installation areas
The customer is responsible for moving valuable, fragile, personal, or obstructing items away from the work area before installation or service.
Delays caused by unavailable access, locked areas, unsafe conditions, animals, occupants, stored items, or other site restrictions may result in rescheduling or additional charges.

17. Payment Terms
Payment terms will be stated in the applicable estimate, proposal, or invoice.
When equipment must be ordered, a deposit may be required before the equipment or materials are purchased.
Unless otherwise stated in writing, the remaining balance is due when the agreed installation or service is substantially completed.
Accepted payment methods may include:
- Cash
- Check
- Zelle
- Credit card, subject to a 3% processing fee
Additional work outside the approved scope requires customer authorization and may result in additional charges.

18. Customer Authorization and Acceptance
By signing this Agreement, approving the estimate electronically, paying the required deposit, or authorizing the Company to begin work, the customer confirms that:
- The customer has reviewed the proposed work.
- The customer understands the difference between the manufacturer’s equipment warranty and the Company’s labor warranty.
- The customer understands the $198 diagnostic and service-call policy.
- The customer understands that non-warranty repairs, labor, parts, materials, and refrigerant may involve additional charges.
- The customer accepts responsibility for routine filters and maintenance.
- The customer understands that permits and related fees are not included unless specifically stated.
- The customer authorizes CS Comfort Time and/or Braza Builders to perform the work described in the approved estimate or proposal.
